Ok,
Iv been checking tab sites and find all of the sister tabs with capos on either the 2nd or 7th fret. Thats not how dave plays it. Anyone know how Dave does it without a capo? Im assuming its a different tuning. Any help would be much apreciated.

Dave's guitar is tuned to Raised B tuning.
(low to high) --> B E A D F# B
Since it's a pain to string up to that, and it will ruin your guitar if it's not set up just for that, put a Capo on the 7th fret like the tabs say. Then, you're in the same exact tuning, as the notes running down the 7th fret are B E A D F# B. Hope that helps.

Isn't the F# tuned up to an A when you play Sister? Maybe I'm completely wrong, I just remember going to learn it then saying, oh fuck it, I have to retune.

No, the Low B is tuned to A. So if you're using a capo, drop the Low E down to D before you capo.

btw, it sounds very good and is easier to play with a capo 7, plus you don't need the extra frets which raised b is typically used for. Also, Dave has capo'd 7.
