Just some things that have been on my mind, please don't point me towards a FAQ, as they are not in depth:
1) Does 'hammering' cause any physical, operational, or emotional damage to a server?
2) What's this diff between active and passive modes?
3) Is it acceptable to disconnect, then immediately reconnect while you switch it to passive or active mode, ignoring the 120 sec rule?
4) Is it acceptable for a high speed to access a slow server, even if it's just to get a couple md5 or info files? What if you cap your download at say 5.5kbs? Or is going on the slow servers off limits at all times, even one that is never full?
5) If a tree falls in a forest, can I still hear Grey Street on my crappy local radio station that has played it once in 9 days?

1) Yes, I have several dents in my computer due to people hammering it, but it also reduces the speed other can download from the server.
2) The differences between the two, are how they try to communite between client and server. -- At least I think :)
3) I would say yes, most servers do not consider it hammering if you disconnect and reconnect one time during the 120 secs... multiple times, or consecutives times it would be hammering.
4) No, most server admins who have setup slow speeds look for users who connect at a slow rate when they are pulling higher speeds and can ban you from their server for doing so.
5) Yes

i believe most site-ops have the server software to automatically ban people who make more than one or two connection attempts in a certain amount of time...on my server for example..you would be banned by logging in two times quickly even if it is just to change a setting...because the server software doesnt know the reason it just knows you tried to login in twice in a short amount of time...

if you posted an ISO: for the md5 or info files I am 100% sure someone would post it up for you as long as you provided info on the show as far who taped it:)

Since I am opinionated I am going to go ahead and give you my thoughts on this...
1) The operational damage that is caused by hammering is that the speeds can actually decrease for the other users on the server.
2) http://slacksite.com/other/ftp.html probably has more information than you really needed to know but explains active vs. passive transfers.
3) There is nothing exactly wrong with it, but you will probably be banned from a lot of servers for doing this for a short period of time. Just like Ian (Where the hell did he go?) said.
4) Absolutely not... If I find a user connected through a slow login and they have a connection speed of greater than 56K they are getting banned. It's that simple. There is a reason why I limit the number of fast users the way I do and I don't appreciate people trying to circumvent the rules.
5) Nope.
