    Almost every state's supreme court has had to make a decision on whether sleeping behind the wheel while drunk should merit a DUI. From what I remember, there are many on either side.

    Well my suspicion is that he was asleep, he was told by Cop A to leave who radioed Cop B and said "Dude in the silver Ford or wtv is hammered" who then pulled him over.

    In Missouri the best means, and only time I've ever known someone got away with a nap on the interstate was a friend of mine who got in the passenger seat and put his keys on the roof. Got a parking ticket, but you do the math.

    From what I understand the law is that your keys cannot be within an arm's length distance in Missouri

    He's off the hook, the circuit court can't really retry him because of double jeoprody. It's probably being passed back for oversight by the police department. But once the court of appeals rules, the circuit can't do shit, and really once the circuit rules it can't do anything else.

    Smart DMB fan? You mean the one who nearly got his 2nd DUI at age 22?

    Maybe the kid should have been more responsible and not drank so much in the first place if he knew he had to drive. And FYI, Alpine does not allow camping, so he knew he'd be forced to leave at some point. Moron.

    Either way, I read about this yesterday, and the whole thing sounded fishy to me.

    First, he was 19. Second. I have 3 years sober. Maybe he has a problem, maybe not. Mayber he coulda been smarter, maybe not. At least he tried not to get on the road. Thats more than I can say for me 4 years ago. The bottom line here is that the Police were incorrect in their actions.

    the general rule for passing out in your car is as follows (but ultimately depends on the state you're in):

    make sure the car is in park. duh. sleep in the passenger seat up front. place your car keys as far away as possible in the back seat (in the back window usually is okay). Keep no additional booze in or near the car. When the cop wakes you up, be as nice as possible and explain that this was a last resort b/c your designated driver left to go hook up with a chick. This story has worked in NJ, MO, and DE.

    really? dude the kid should be given the key to the city... if he was a what would be "second offender" he clearly learned his lesson and knew he wasnt good enough to drive. I give the kid props... maybe he has a drinking problem, but hell he isnt putting me at risk with his problem, he avoided driving and realized the state he was in... we should all be saying thank you to him because he was smart enough not to get on the road and kill one of us or one of our relatives...

    Good point. And I really would have applauded him had he stood up for himself when the cop told him to leave.

    I'm just saying that he could have been more responsible in the first place if he knew he was going to have to drive. But like you said, atleast he knew enough not to drive before being asked to leave.

    But none of us really know the real story either. Maybe the cop was telling the truth? Maybe the kid was telling the truth? Maybe it's a mixture of both stories?

    I totally agree with this. It was amazing to me that when I got clean and didn't have drugs on me all the time, how much less I got in trouble... lol...
    But there are no shortage of them who abuse their power. And if the representation of this is true, and I assume that for the court of appeals to rule on it there must have been credible evidence, this was kind of unfair.

    My previous legal ramblings were pointed out to be wrong. I can concede that they probably were. But considering that the issue of the kid being underage was thrown out, I can say with some certainty that this hearing was not about responsibility by the driver. Just actions by the police.

    Thanks! That was this Monday... I did a lot of dumb shit. The police did fuck me over, but I was responsible for 95% of that trouble.

    The thing is that if someone is trying to do the right thing, its unfair to punish them. Even if its following them doing the wrong thing. Arrest him for tresspassing (not a big deal under the circumstances), ticket him for illegal parking, but dont tell him to drive. I don't know who's side is right, but the court filing really illustrates a lot of effort on behalf of this cop to wake him up. And while the officer says he told him to sleep it off and he'd be back to check on him later, how many of us have been to a party when we were under age, drinking, and the first thing the cops did on arrival was tell everyone to get in a car and go home?

    DUIs are a BIG deal if you haven't gotten one, believe me that its a hard spot on your record to overcome.

    I hate cops...I've had numerous run ins...A few times I deserved it, a few times I didn't, but what's left in my head is that a lot of them (not all) are scheming little pricks who had a few too many bad experiences in high school...their victimizers on a high horse

    I've said it before I'll say it again...I will respect town cops when they need a four year degree to arrest me

    Some of us have had some pretty shitty run-ins with cops too. Don't kid yourself and anyone else for that matter if you think every cop out there is kind and courteous and every experience with them is gum drops and roses.

    Don't get me wrong, there are really good cops, but there are also cops who are complete pricks.

    I agree. It's been my experience that the most professional cops are the state troopers and big city cops. The cops from smaller boroughs and municpallities tend to get more like Rosco and Enos.

    I hate cops...I've had numerous run ins...A few times I deserved it, a few times I didn't, but what's left in my head is that a lot of them (not all) are scheming little pricks who had a few too many bad experiences in high school...their victimizers on a high horse

    I've said it before I'll say it again...I will respect town cops when they need a four year degree to arrest me
    ive been pulled over by state troopers and town cops.
    i argue with the town cops, dont give much respect, theyre just losers who didnt know what they wanted to do in life.
    state troopers, especially in NY (only Massachusetts has a tougher program than New York to become a State Trooper) IMO arent as out to get.
