I was served papers two weeks ago. I had been working with an attorney drafting a motion to seek equal parenting time and my ex beat me to it. She is now seeking sole legal and sole psyical custody. Allegations of drug sales and use as well as not following doctors orders are her basis. She wants me to only have supervised visits, and no more overnights. I hired an experienced family law attorney. Court date is December 2nd. Past two weeks have been gut wrenching, to say the least. Just hoping that I can still tuck my kiddos into bed at least once in awhile again. Cannot believe this woman can be this heartless and destructive and hurt the kids all at the same time and not give two shits. I guess control and money do funny things to judgement.

Looking back, the child support, in my opinion, was done first to intentionally drain me of funds to properly hire representation to defend her bogus costody modification. Shes been plotting this for awhile....

I took out a loan to pay for my attorney. Fuck it. I have everythign to lose at this point. Im not giving this nutball sole control of my children. No way in hell.

Ex's attorney agreed to mediation. Basically admitted they would lose their case, so no court today! Thats cool, but I shelled out for a mediator over 3 months ago and she had no interest in cooperating then. So now its cool because shes being forced to, in the meantime im closing in on $5,000 spent over this bullshit with no foreseeable end in sight? Time to recover those fees, and get my kids.

All in all though, great news. Hope this brings an end to this crazy drama.

Yeah this thread has been an outlet for me throughout the last two years. I guess if they ever come across it and discover how evil their mother is, so be it. Ill never stop fighting for those two kids. Hope they see that, too.

What is her end game? Does she want the most amount of child support she can get? Just give it to her... You can always make more money, but you can never make up the time you lose with your kids. Dudes get fucked when it comes to custody... it sucks, but the most important thing is being involved in raising your kids.

Money is a motivator for her, but honestly, the power involved trumps it, in my opinion. She lives on power and control. Money kind of goes hand in hand with it, because not only does it help her, but it saps me of my livelihood.

I can make more money, sure. But in no way is giving close to 75% of my gross income to this woman acceptable. Im young enough and so are my kids that im willing to spend the cash on legal fees now to just get things as close to fair/even as I possibly can, and prevent this crazy shit form happening again in the future. That may mean I take my kids during the school year and they go to mom on the weekends and in the summer. This has been what the kids have wanted for some time...Either way, I feel like I can provide for them more stability, as well as emotional and financial support, than their mother can.

We will see how things play out in mediation.

Yeah... I'd try to keep the legal fees in check though. There's not a lot of wiggle room in what you would pay for child support anyway. Whether you have them part of the time or not, you shouldn't be paying more than 25-30%.

Absolutely. Im just glad its headed to mediation and not to the courtroom....should help keep the fees down significantly. Hopefully, I can get equal parenting time (or even better just become the custodial parent), and get our mess of a divorce decree reworded to provide protection in the future.

Good luck with everything. I went through it 5 years ago when I got custody of my daughter. It isn't easy for a man to get custody, the cards are already stacked against us. You just need to be able to make a case of why your child is best suited to be with you.

It isn't cheap. I was over $10,000 when all was said and done.

For sure. Ive been documenting like a mofo for months now...This latest scheme to cut me out of the kids lives is the icing on the cake to the alienation that has been occurring. Im hoping everyone in mediation can see that.

Beyond that, im hoping that her not having a job, or a home, coupled with the childrens wishes, should be sufficient grounds for a change. Im making it a point to tell everyone I still think the kids need a relationship with her, but that she has been a terrible custodian of the responsibilities that come with being the custodial parent, and that I am far better suited in that regard.

It isn't cheap. I was over $10,000 when all was said and done.

Yeah give or take 10K is about what im expecting by the time its all said and done...Might be able to recover part of it, maybe not. Either way I feel that its gonna be money well spent in the end.

It is, there's no amount of money in the world I wouldn't have spent to get my daughter. I would have gone into debt that I'd have to pay off until the day I die, and it would have been worth every penny, every sacrifice.

No idea...was just going to ask my attorney if it was feasible. Ex opened frivolous litigation. I had to defend myself as a result. In my mind, I should be able to recover. If its a no go, ill eat it, but never hurts to ask.
