Most reports I read indicate that Stewart revved his engine at the kid, which commonly causes sprint cars to fishtail. I'm sure he knew that.
He could be in real bad shape even if not charged with murder. Negligent criminal homicide is a thing in many states, not to mention vehicular manslaughter (or its NY equivalent), which doesn't require intent.
