    Well if there is video, and I am guaranteeing there is, you can see if his car swerves at all given an indication of him hitting the throttle.

    Um... the car moved? There's bound to be tons of witnesses. Stewart knows what he is doing behind the wheel.

    I was under the impression that the car was moving around the track when the kid went out onto it. If Stewart ran him down from a dead stop, then yea, I'd say that's pretty clear cut.

    Most reports I read indicate that Stewart revved his engine at the kid, which commonly causes sprint cars to fishtail. I'm sure he knew that.

    He could be in real bad shape even if not charged with murder. Negligent criminal homicide is a thing in many states, not to mention vehicular manslaughter (or its NY equivalent), which doesn't require intent.

    What the reports say is that it happened after a yellow flag lap. So Stewart's car was stopped or in a coasting/slowed state. That's the only way the car would fish tail anyway.

    This happened in some small town in front of maybe 500 people. Stewart was the only pro there.

    This was a hobby, not a sport.

    So if I'm in a rear wheel drive car, and I jerk the wheel hard to one side while hitting the breaks, the back end won't slide at all?

    They cancelled the medical helicopter. Not like there was a level 1 trauma center a few minutes away.
