This is what a friend of mine in KY told me:

"Actually it's a messed up version of the Kentucky state laws. Any sex with a minor falls into a sodomy charge. It's often tagged on in these cases in case the argument "it was consensual" gets tossed in. The law is worded funny, but the charge of sodomy is always added to a case like this, but in the state of Kentucky it's got nothing to do with anal penetration."

Agreed, which is why I don't think saying "the student was 18" is fitting. There are laws about sexing up your student in place because it's taking advantage of a position of authority.

I think there was even a story that was posted in here where the student was 18, age of consent in most states, and had relations with a teacher. However, the state that this allegedly took place, the law was very clear that even if the student was over 18 in the case of student-teacher relationship, or whatever the legal age of consent was, it was still illegal and a crime.

Special education could mean pretty normal. Like maybe a slight case of autism or something. Or even a dyslexic kid or something like that where nothing is really wrong with them at all. Then it's not taking atvantage of someone.

Now if it's like some kid that is actually "retarded" then it's a problem.

Ok I'm not avdvocatiing having sex with kids. I'm simply saying the kid was 18 and we don't know exactly what category of special education this kid is in. If this Kid is dyslexic or something it's not any worse then any other case where a teacher is having sex with a kid.
