I wonder if it's legal to try to detain someone in IL for something like this? I'd imagine not or I feel like there'd have been a lot more cases.

I don't think that DA didn't charge the shooter because of his prior arrest and mental health. That seemed to be added to the end where it said something like "which would explain is violent reaction" or something to that effect. It's in one of the links and was written by the DA. If it can't be used in court for any reason, then it's weird he would have added it.

Anyway, I don't agree with the entire premise of the law that states it's legal to for a citizen to detain someone because they "suspect" someone of committing a felony.

Based on what I've read, if it turns out that the shooter can prove that the kid stole something prior and that amounts to a felony, they won't be arrested or charged.

In addition, the kid was arrested before for bringing a gun into a school gymnasiun (2012) and allegedly has mental issues that cause violent outbursts. Niether of those are going to help.

To me, that's why this is going to a grand jury. If the guy is indicted, he will be arrested and, most likely, tried.

I haven't read anything to indicate the shooter has any ounce of proof the kid stole anything, much less anything valuable enough to bring it to felony status. Can someone not go perform a "citizen's arrest" on these guys and say it's for murder?

Once again what is the fucking point to this post? People have trucks for transportation and you can haul stuff in the back of the truck. its a practical vehicle. Guns are for protection. lets say someone breaks in, you can protect yourself with a gun depending on the situation. Its better to have a gun available then not.

Right, but this thread probably isn't the place to try to defend guns or trucks, since someone in a truck used a gun to murder someone on video. Depends. You are actually more likely to get shot if you confront a criminal with a gun. If you own a gun it's more likely it will be used on a family member than an intruder. It's more likely you or someone in your house will shot themselves or someone else on accident or on purpose. Owning a gun is dangerous.
